As of 2006, the International Organization for Migration has estimated the number of foreign migrants in North America to be over 45 million immigrants. The immigration system is very complex and immigration laws have gotten stricter within recent years, especially regarding immigration violations. Family Based Immigrant Visas
Two groups of family based immigrant visa categories include immediate relatives and family preference categories. Immediate relative immigrant visas are based on a close family relationship with a United States (U.S.) citizen described as an Immediate Relative (IR). The number of immigrants in these categories is not limited each fiscal year. Immediate relatives such as husbands, wives, and unmarried children under age 21 will not have to wait for an immigrant visa number. Fajardo Law Group, LLC can assist you with bringing your spouse, children, or other relatives to the United States. If you are an American citizen, you may also bring your fiancé(e) to the United States to marry and live here. We also specialize in preparing K-1 visas and can guide you through this process.
Non-immigrant visas
There are various types of nonimmigrant visas for temporary visitors to travel to the U.S., if you are not a U.S. citizen or U.S. lawful permanent resident. Some examples of visas Fajardo Law Group, LLC can assist you with are student visas, work visas, and tourist visas.
Lawful Permanent Residents (Green cards)
A green card is a permit which provides you with permanent residence status and allows you to live and work permanently in the U.S. We can assist you by determining whether you are eligible for a green card and if so, can guide you through the process of becoming a legal permanent resident.
Work Permits/Employment Authorizations
A work permit, also known as an Employment Authorization, may be issued to someone who is not a U.S. citizen or lawful permanent resident and is interested in legally working in the country. Our office can assist you in obtaining or renewing an Employment Authorization Document.
Naturalization/Citizenship
If you are a permanent resident and are interested in becoming a United States citizen, we can guide you through the naturalization process. Our office can assist you in preparing for the interview and history test required for U.S. citizenship. If you have a criminal background or residency or visa issues, we can work on finding the best option for you with respect to your case. We also advise clients against applying for naturalization if it could lead to a possibility of deportation.
Asylum
If you are facing removal, one form of relief which may be available to you is defensive asylum. In order to be eligible, you must show that deportation to your home country would result in persecution based on your race, religion, political opinion, or membership in a group. Asylum can also be granted to a person who is outside of their home country and is unable or unwilling to return because of such persecution. Our office can assist you by filing an Application for Asylum and Withholding of Removal and represent you in court proceedings regarding your request for asylum.
Deportation/Removal Defense
If you are not a U.S. citizen, you can be deported for violating any U.S. criminal or immigration laws. Removal and deportation defense is a complex area of immigration law and requires a skilled attorney to challenge your deportation and present the best possible defense against removal. U.S. immigration laws contain a 10 year bar provision which states that individuals deported from the country, or with a year or more of unlawful presence in the U.S., must remain outside of the United States for ten years. Therefore, you want a skilled attorney to assist through all court proceedings and who will find the best strategy to keep you from being deported. Our office can provide you with aggressive representation to ensure the best possible outcome in your case.

Appeals
If you or a family member has received an order for deportation, you have the right to appeal your case. You also have the right to appeal the denial of a visa or asylum application. During an appeal, we will attempt to convince the Board of Immigration Appeals that the immigration judge was wrong and preserve any issues of fact and/or law for the record. Therefore, in the case of a deportation matter, if it is appealed to the Circuit Court of Appeals, the attorney can attempt to distinguish your case from previous case law and obtain a reversal.
